    Joel G. Weinberg, Esq.

    Joel brings over 15 years of hands-on litigation experience helping clients to resolve cases and disputes.  Joel has represented both plaintiffs and defendants, has jury and bench trial experience, and has litigated a variety of claims including related to real property, business disputes, personal injury, and consumer law.

    Prior to starting Precision Counsel, APC, Joel was a  Senior Counsel with L&F Brown, P.C. (formerly Liu, Brown & Firoozmand, P.C.) where (on behalf of individuals and entities) he litigated all aspects of a civil practice focused on real estate and business litigation, including partnership disputes,

    lending disputes, commercial landlord-tenant disputes, title disputes.


    Before L&F Brown, Joel was a Vice President, Trial Counsel, for Fidelity National Law Group, where he focused on real estate for insured lenders / owners and the company as an in-house counsel for the Law Division of Fidelity National Title Group, Inc. and he litigated disputes as to ownership, easements / boundaries, lien priority, and other title defects. 


    Before FNLG, Joel was an Of Counsel at Kabateck Brown Kellner LLP (now Kabateck LLP) where he prosecuted cases for plaintiffs, including personal injury matters and consumer class actions. 


    Joel also litigated real estate and business matters at Freeman, Freeman & Smiley, LLP (now known as Saul Ewing LLP), including commercial landlord-tenant disputes, lending disputes, partnership disputes, and title disputes, and he also defended personal injury, premises liability, and products liability cases at Schaffer, Law, McNaughton & Chen. 


    In addition, Joel was named among the list of 2014 Southern California Rising Stars by Super Lawyers Magazine.

    Joel received a B.A. in History (with a Minor in Government) from the University of Virginia in Charlottesville, Virginia.  He received a J.D. from Southwestern University School of Law (now known as Southwestern Law School) where he graduated Cum Laude and was a Lead Articles Editor of the Southwestern University Law Review. 


    During law school, Joel was a judicial extern to the Honorable Earl Johnson, Jr. of the California Court of Appeal, Second Appellate District, and to the Honorable Florence-Marie Cooper of the United States District Court, Central District of California. 


    In addition, during law school, Joel was a law clerk at plaintiff’s personal injury law firm.

    Joel is admitted to practice law in the California state courts as well as the U.S. District Court, Central District of California.

    - Successfully resolved dispute by minority shareholders (closely-held corporation) and minority members (related LLC) in litigation with claims for breach of contract, breach of fiduciary duty, accounting, etc.;


    - Successfully represented commercial tenant in defense of breach

    - Successfully represented commercial tenant in defense of breach of lease suit and prosecute cross-complaint

    for fraud, breach of contract, etc.;


    - Represented 50% shareholder (closely-held corporations) in litigation with claims for breach of contract, breach of fiduciary duty, accounting, etc.;


    - Represent former LLC member in litigation concerning breach of and fraud related to membership redemption agreement;


    - Represent property owner in action to recover monies paid to unlicensed contractor for defective

    construction work;


    - Represent a lender against borrowers and related parties after they abandoned real estate renovation project and lost the property to foreclosure;


    - Obtained dismissal of an unlawful detainer action after Court sustained our demurrer to complaint;


    - Represented family members regarding quiet title suit concerning real estate development project;


    - Represented nominated executor and designated beneficiary regarding competing probate proceeding; obtain stipulated reversal in appeal for the client (Cal. 5th Appeal Dist. Case F088009);


    - Counsel clients regarding issues concerning insurance coverage, commercial leases, real property (multifamily, commercial) and personal property;


    - Represent investors regarding real estate development projects;


    - Prepare Respondent’s Brief for title insurer in successful appeal (affirming trial court’s grant of summary judgment) (Cal. 2nd Appeal Dist. Case B324056);


    - Assisted with proceeding for individual seeking relief regarding LLC with claims for breach of fiduciary duty, accounting, breach of implied covenant, involuntary dissolution, fraud, rescission, declaratory relief;


    - Assist with representation on behalf of lender’s assignee in title dispute regarding claims for quiet title, reformation, declaratory relief;


    - Assisted with representation of property owners in real estate title dispute regarding claims for adverse

    possession, quiet title, declaratory relief;


    - Assisted with preparation of petition to compel arbitration regarding licensed securities brokerage.


    - Obtained default judgments quieting title in favor of clients’ loans;


    - Obtained a default judgment for declaratory relief establishing client’s lien priority;


    - Defended homeowner in quiet title action brought by sibling who contested homeowner's ownership;


    - Resolved a lien priority case wherein earlier-in-priority lienholder claimed it had not been paid;


    - Represented homeowner wherein neighbor’s improvements encroached onto client’s property;


    - Represented property owner in defense of unlawful detainer action and also prosecuted quiet title action on behalf of property owner wherein opposing party claimed it owned the property at issue;


    - Represented owner of a fractional interest of property wherein opposing party claimed it was 100% owner of that property by an unrecorded deed;


    - Represented property owner in action wherein opposing party denied an easement existed on its property;


    - Represented note holder of loan wherein the deed transferring the property to the borrowers and deed of trust were not recorded;


    - Represented property owner in defense of action brought by homeowners’ association which sought to

    encumber property by CC&Rs recorded decades ago;


    - Represented company in interpleader action regarding disputed escrow funds;


    - Represented company and employee in defense of action claiming escrow negligence.


    - Obtained a defense victory on third day of a bench trial (at which second chair) on $450,000 fraud claim;


    - Obtained a defense victory following a multi-day bench trial (at which second chair) on fraud and negligent misrepresentation claims seeking $3,600,000;


    - Obtained a stipulated judgment for $64,000 on a fraud claim after opening statements at a bench trial;


    - Obtained judgments pre-trial and after trial (affirmed on appeal) in self-service storage facility lien cases;


    - Litigated a multi-day unlawful detainer jury trial (at which second chair);


    - Litigated a multi-day bench trial (at which second chair);


    - Argued before the California Court of Appeal;


    - Assisted in the successful defense against a putative class action;


    - Favorably resolved (as part of a team) lawsuit involving an option to purchase property;


    - Obtained injunctions on behalf of and cleared title for property owners.
